Opinion: man wants to sue for teenager for 120 thousand..?

so "tod" was 13 when he was riding his bike on the sidewalk. he was crossing in the crosswalk when a professional-looking biker ("Larry" - 35) riding alongside cars in the street came up and they crashed at the same time. Larry broke his collar bone in the incident. before the crash, larry was having problems with his shoulder and was given the option to have his problems corrected through a very expensive surgery. since it wasnt absolutely necessary, he didnt go through with it. after the biking crash, larry's doctors said the shoulder surgery was NEEDED, since the collar bone breaking somehow made it worse. anyway, larry is trying to sue tod for $120,000. what do you think?
